NO ENTRY FEE. NO PURCHASE OR OBLIGATION NECESSARY TO ENTER OR WIN. Entry deadline is February 29, 2008.

Eligibility: The FM [Raise Your Game] Sweepstakes (the “Promotion”) is open to legal residents of the U.S. (excluding New York, Florida, Rhode Island, Puerto Rico), eighteen (18) or older, as of the date of entry, who have an active e-mail account and Internet access as of the beginning of the Promotion period. Employees of Sponsor and its respective parent companies, affiliates, subsidiaries, advertising, promotion, fulfillment or other coordinating agencies, individuals providing services to Sponsor through an outsourcer or temporary employment agency during the Promotion period, and their respective immediate family members and persons living in their same household, are not eligible to participate in the Promotion. Participation in the Promotion constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules & Regulations (“Official Rules”). VOID WHERE PROHIBITED.

To Enter: You may enter the Promotion in one of two ways:

• To enter online without obligation, submit your written idea for a new video game (as described below in 2(c)) to http://goraiseyourgame.com on the Sponsor website (the “Sponsor Sweepstakes Website”) between January 22, 2008, at 12:01am EST, and February 29, 2008, at 11:59pm EST. Fill out the entry form in its entirety, follow the directions for submitting and click on the button to submit the form.
• To enter by mail without obligation, hand write your name, mailing address, phone number, and e-mail address on a 4”x 6” card with written idea for a new video game (as described below in 2(c)) and mail to: The FM Raise Your Game Sweepstakes, Federated Media, 123 Second Street, Sausalito, CA 94965. Mail-in entries must be postmarked by February 22, 2008, and be received by February 29, 2008.
• Each entry shall be written in English and shall be no less than one sentence, nor more than 150 words describing the idea for a new (i.e., not commercially available, in production or owned by another person or entity) video game. Sponsor or Sponsor’s employees or agents shall review each submitted entry to determine if such entry meets the requirements described herein. Each entry that meets these requirements, as well as the eligibility requirements in Section 1 above, will be considered an “Eligible Entry” and will be entered into the random drawing for the Prize. Any entry that is defamatory, contains obscenity, profanity, or is otherwise unlawful, or that consists of a word or phrase used multiple times in the entry shall not be considered an Eligible Entry and shall be disqualified from the FM Raise Your Game Sweepstakes.

No mechanically reproduced mail-in entries are allowed and any use of robotic, automatic, programmed or the like entry methods will void all such entries by such methods.

Only one entry per person, household and/or e-mail address is permitted, regardless of method of entry. Entrants submitting multiple entries or violating any of these Official Rules may be disqualified.

Prize Drawing: All Promotion entries meeting the requirements of these Official Rules will be entered into the prize drawing, to be held on or around March 11, 2008, at Sponsor’s offices at 123 Second Street, Sausalito, CA 94965. The drawing will be conducted by independent judges whose decisions are final and binding. Grand Prize Winners will be selected at random from among all Eligible Entries received. Winners will be notified by e-mail.

Prizes and Odds: The one (1) Grand Prizes to be awarded from the Promotion are as follows:

• One (1) Grand Prize(s): one Microsoft Xbox 360 console, retail value of approximately $350 (US).
• Total value of all prizes to be awarded: $350 (U.S.).
• The odds of winning the Grand Prize are dependent upon the number of Eligible Entries received.

Notification of Winners: Winners will be notified by e-mail within five (5) business days of the Prize drawing, and shall be required to sign and return an affidavit of eligibility and publicity/liability release within seven (7) days of notification. If a selected winner cannot be contacted, is ineligible, fails to claim a prize and/or where applicable an affidavit of eligibility and publicity/liability release is not timely received, is incomplete or modified, the Prize may be forfeited and an alternate winner will be randomly selected from remaining valid, Eligible Entries timely submitted. In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the e-mail account specified in the entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. No automatically generated entries will be accepted.

General Rules: By entering the Promotion, you agree to be bound by these Official Rules. The Promotion is offered by Federated Media Publishing, Inc., 123 Second Street, Sausalito, CA 94965, which are not responsible for (i) late, lost, delayed, damaged, postage-due, incomplete, illegible, misdirected or undeliverable entries, responses, or other correspondence, whether by e-mail or postal mail or otherwise; (ii) theft, destruction, unauthorized access to or alterations of entry materials; (iii) phone, electrical, network, computer, hardware, software program or transmission malfunctions, failures or difficulties; or (iv) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries. The Sponsor is also not responsible for any malfunction of the entire Sponsor Sweepstakes Web site or error in the collection, processing or retention of entry information.

By entering the Promotion, You further agree to release, indemnify, defend and hold Sponsor and its parent, affiliates, subsidiaries, directors, officers, employees, sponsors and agents, including advertising and promotion agencies, and assigns, and any other organizations related to the Promotion, harmless, from any and all claims, injuries, damages, expenses or losses to person or property and/or liabilities of any nature that in any way arise from participation in this Promotion or acceptance or use of a Prize or parts thereof, including without limitation (i) any condition caused by events beyond Sponsor’s control that may cause the Promotion to be disrupted or corrupted; (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of the Prize, or acceptance, possession, or use of the Prize, or from participation in the Promotion; and (iii) any printing or typographical errors in any materials associated with the Promotion. Winners agree to be bound by these Official Rules, and Sponsor’s decisions in all respects relative to the Promotion are final.

IN NO EVENT WILL SPONSOR BE LIABLE TO YOU FOR ANY DIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THE PROMOTION, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Additional Conditions: Except where prohibited, by winning any prize, Winner consents to the use of his/her name, photo and/or likeness, biographical information, entry and statements attributed to winner (if true) for advertising and promotional purposes, including without limitation, inclusion in Sponsor newsletters, the Sponsor Sweepstakes Website at http://goraiseyourgame.com and Sponsor’s homepages at http://www.federatedmedia.net, without additional compensation. All entries and ideas from Eligible Entries become property of Sponsor and none will be acknowledged or returned. Allow 6-8 weeks for delivery of prizes.

Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Promotion in whole or in part, in the event of fraud, technical or other difficulties or if the integrity of the Promotion are compromised, without liability to the entrant. Sponsor reserves the right to disqualify any entrant or winner, as determined by Sponsor, in its sole discretion. The Promotion is subject to these Official Rules and all applicable federal, state, provincial and local laws and regulations apply. As stated above, the Promotion is void where prohibited or restricted by law. By participating in this Promotion, you acknowledge that you have read these official Rules and agree to abide by them and by the decisions of Sponsor, which are final and binding on all matters pertaining to the Promotion.

These Official Rules are governed by the law of the State of California, without reference to rules governing choice of laws. Any action, suit or case arising out of, or in connection with, this Promotion or these Official Rules must be brought in either the federal courts located in the Northern district of California or the state courts located in Marin County, California.

Personal Information: Sponsor may collect personal data about entrants online, in accordance with its privacy policy and as may be more specifically set forth in these Official Rules. For example, during entry registration, you will be asked to provide certain information such as your first name, last name and valid email address. You will also be asked to confirm that you are a US resident, over the age of 18, and you will be given the opportunity to opt-in to receive future emails from Sponsor. By participating in the Promotion, entrants hereby agree to Sponsor’s collection and use of their personal information and acknowledge that they have read and accepted these Official Rules and Sponsor’s privacy policy.
